By booking a shoot, signing a proposal or statement of work, paying an invoice, or using the photography and video production services of Photografia Productions, LLC, you agree to these Terms of Service. These terms govern the provision of our services, including but not limited to commercial photography, videography, editing, post-production, and related creative production work.
Photografia Productions, LLC will perform the services described in your written agreement or proposal with reasonable professional skill and care. Weather, venue access, third-party vendors, talent, or equipment availability may affect schedules; where that occurs, we will work with you in good faith to adjust timelines. Specific creative outcomes (for example, a particular viral result or award) cannot be guaranteed.
Fees, deposits, retainers, and payment schedules are as stated in your project agreement or invoice. Unless otherwise agreed, invoices are due according to the terms printed on the invoice. Photografia Productions, LLC may pause work or withhold delivery of final files until required payments are received. Hard costs (such as location fees, permits, or licensed music) may be billed separately when applicable.
To deliver quality results, Photografia Productions, LLC may need timely access to locations, schedules, brand assets, approvals, and clearances (including releases for people or property where required). Delays in feedback or access may shift delivery dates. The client is responsible for accuracy of information provided for the project.
Rights to final photo and video deliverables, and any licensing scope (e.g., web, print, duration, or territory), are defined in your project agreement. Until full payment for the applicable deliverables is received, Photografia Productions, LLC may retain copies and limit usage as set out in that agreement. Photografia Productions, LLC may use non-confidential, anonymized portfolio samples or behind-the-scenes material for promotion where permitted by contract and law.
Either party may terminate an engagement as provided in the signed agreement. On termination, you remain responsible for fees and costs incurred through the termination date. Photografia Productions, LLC will cooperate on an orderly wrap-up, including delivery of work paid for, subject to the terms of your contract.
